Update on Brandon McInerney Gay Hate Crime Trial

The murder trial of Brandon McInerney is continuing in Chatsworth and there have been some explosive testimony since last we checked in. 14-year-old McInerney, now 17, fatally shot his 15-year-old classmate Lawrence (Leticia) King twice in the head on February 12, 2008 when both boys attended E.O. Green Junior High School in Ventura County, California. McInerney is being tried as an adult (which I do not agree with) and is being charged with first-degree murder in a trial that began July 5, 2011.

The latest revelations are that Brandon McInerney was apparently repeatedly physically and sexually abused by his father.
Brandon McInerney was molested by a relative as a boy, a family secret that his older half brother didn't learn until two weeks after McInerney shot a gay classmate to death in February 2008, the half brother told jurors in a Chatsworth courtroom Wednesday.
James Bing testified that McInerney’s father cried hysterically as he revealed the molestation that occurred when Brandon was about 9 years old.
The older McInerney was upset because the family had dealt with the problem internally, sending the relative away for years, instead of reporting it to police and getting Brandon help, Bing told the courtroom.
McInerney’s father, who is now dead, believed the memory of the molestation was what caused his son to react so violently when Larry King began dressing like a girl and flirting with McInerney at their Oxnard junior high school, Bing said.
[...]
When McInerney’s father died in 2009, coroner's officials found alcohol and drugs in his system. Bing said his stepfather was frequently high on drugs and was sadistic.
He once put soap into a sock and beat the boys with it for an offense that later turned out to have been committed by someone else, Bing testified.
Billy McInerney poured Tabasco sauce down's the boys' throats when they were sleeping and would pull down their pants in front of their friends, disparaging the size of their genitals, Bing said.
"He was a mean, nasty person,'' Bing said.
How convenient that the alleged sexual molestation was never reported to anyone else outside the family so it will be different to corroborate. James Bing is Brandon McInerney's half-brother (same father different mother) and is the person speaking in the video given at the top of this post. If I were a juror I would take the testimony of a family member of the accused with more than a grain of salt.

What would you b willing to tell the court if a member of your extended family was accused of a crime for which they faced 53 years to life in prison if found guilty?

Wow! New Anti-Homophobia PSA Airing in Jamaica

As many of you must know, the island of Jamaica has a (well-deserved) reputation as "the most homophobic place on Earth" despite being a tropical paradise and tourist destination. There have been several reports of extra-judicial killings and beatings of individuals believed to be LGBT.

Anyway, a coalition of groups has organized an anti-homophobia public education campaign which includes a PSA (public service announcement) called "Unconditional Love." You can watch it here. This is great news, because it demonstrates that there is an organized effort to combat the unrelenting homophobia which has been festering in most social circles of Jamaica.

WATCH: Conservative Republicans' Ayn Rand Problem

I hope lots and lots of Republican primary voters watch this video of Ayn Rand spouting her views on religion (which I agree with). It will be interesting to see how they agree with everything he says about capitalism but reject everything she says about "God."

I have no difficulty in saying I reject everything she says about capitalism but agree with what she says about "faith."

UPDATE on NY Marriage Equality

The latest news from New York is that the legislative session has been extended to deal with three issues: rent control, property tax and, of course, marriage equality. The first two of the three issues have now been settled:
[State Majority Leader Dean] Skelos said he, Gov. Cuomo and Assembly Speaker Sheldon Silver are on board with agreements to extend the rent regulation law, restore a 421-A property tax abatement for city housing developers, SUNY 2020, a local property tax cap, and a mandate-relief package for localities.
Gay marriage, he said, will be conferenced once there is agreed upon language concerning religious protections. "I think we're going to have a real good concluding package," Skelos said.
Openly lesbian New York City Council Speaker Christine Quinn, who is one of the frontrunners to become the next Mayor of New York City following Anthony Weiner's resignation, has said that she expects a vote on marriage equality Wednesday or Thursday.

WATCH: Final Trailer for Final Harry Potter Movie!

The movie is released July 15, 2011, in 3D and 2D. It looks amazing (much better than Part 1, which was a bit disappointing), I may actually re-read the book before seeing the movie since it's been 4 years since the book came out.

WATCH: Olson/Boies Tribute To Loving v. Virginia

June 12 is the 44th anniversary of the unanimous Loving v. Virginia United States Supreme Court case which overturned all state-enacted bans on interracial marriages. David Boies and Ted Olson are the lead attorneys in the federal lawsuit against Proposition 8, a 2008 California ballot measure which bans same-sex marriage. They have recorded a special video tribute acknowledging the significance of the Loving decision, and its potential impacyt on the Perry v. Brown case.

Herman Cain Says Homosexuality Is A Sin and A Choice

MadProfessah first blogged about Black republican presidential candidate Herman Cain way back in April, noting then that he was once a mathematics major.

Cain has started making headlines because he is starting to appear in the middle or at the top of polling lists in early Presidential primary states, with more support than media darlings like Jon Huntsman and Tim Pawlenty.

Openly gay Miami Herald blogger Steve Rothaus has the transcript:
"I believe homosexuality is a sin because I'm a Bible-believing Christian, I believe it's a sin," he said. "But I know that some people make that choice. That's their choice."
Cain was asked: "So you believe it's a choice?"
"I believe it is a choice," he responded.
I wonder if Mr. Cain believes in the Golden Rule?

New TV Ad For Marriage Equality in New York

Since I lived in New York State for 8 years I stll pay careful attention to politics (especially LGBT politics) there. The battle to pass legislation to enact marriage equality in New York when the Governor, the lower House and as much as 58% of the general public support is fascinating to me. Republicans control the State Senate and they seem adamant about not allowing legislation to move forward. There are two weeks left of this legislative session, which ends JUne 20.

New Yorkers United for Marriage has released a second television ad which will start airing this week around the state.

NYC Mayor Gives Amazing Marriage Equality Speech

Mayor Mike Bloomberg gave a speech at Cooper Union yesterday where he strongly and passionately explained why marriage equality needs to be enacted in New York State as soon as possible. The key section is where Bloomberg demolishes all the typical reasons for not supporting marriage equality is here:
“In talking to State legislators who do not yet support marriage equality, I can sense that many of them are searching their souls for answers – and they are torn. Like all of us, they have friends and family and colleagues who are gay and lesbian. They know gay and lesbian couples who are deeply in love with each other – many of whom are loving and devoted parents, too. They know those couples yearn to be seen and treated as equal to all other couples. And they often hear from their own families – especially their children – that this is a civil rights issue. I hope they listen to their kids carefully and make them proud with their foresight and courage.

“Now, I understand the desire by some to seek guidance from their religious teachings. But this is not a religious issue.  It is a civil issue. And that is why, under the bill proposed in Albany, no church or synagogue or mosque would be required to perform or sanction a same-sex wedding – as is the case in every state that has legalized marriage equality.

“Some faith communities would perform them; others would not. That is their right. I have enormous respect for religious leaders on both sides of the issue, but government has no business taking sides in these debates – none!

“As private individuals, we may be part of a faith community that forbids divorce or birth control or alcohol. But as public citizens, we do not impose those prohibitions on society. We may place our personal faith in the Torah, or the New Testament, or the Koran, or anything else. But as a civil society, we place our public faith in the U.S. Constitution: the principles and protections that define it, and the values that have guided its evolution. And as elected officials, our responsibility is not to any one creed or congregation, but to all citizens.

“It is my hope that members of the State Senate majority will recognize that supporting marriage equality is not only consistent with our civic principles – it is consistent with conservative principles. Conservatives believe that government should not intrude into people’s personal lives – and it’s just none of government’s business who you love!

“Conservatives also believe that government should not stand in the way of free markets and private associations – including contracts between consenting parties. And that’s exactly what marriage is: a contract, a legal bond, between two adults who vow to support one another, in sickness and in health.

“There is no State interest in denying one class of couples a right to that contract. Just the opposite, in fact. Marriage has always been a force for stability in families and communities – because it fosters responsibility. That’s why conservatives promote marriage – and that’s why marriage equality would be healthy for society, healthy for couples and healthy for children."
Many LGBT activists are upset with the Republican billionaire Republican mayor because he has previously donated hundreds of thousands of dollars to the state GOP, allowing them to re-capture the majority in the State Senate, where marriage equality legislation is currently under consideration. There are 26 of 28 Democrats Senate votes in support of marriage equality but it takes 32 votes to pass in the 62-member body and the 32-member Republican caucus has a history of bottling up and killing pro-LGBT legislation.

In 2009, a marriage equality reached the floor when Democrats held the majority but failed when traitorous Democrats who had taken LGBT money promising to support marriage equality voted against the legislation, which failed 24-38.

Let's hope that 2011 things end differently and enough NewYork State Senators will realize that it is time to allow access to civil marriage to all New York families.
